Swatantra Bhardwaj has been sent to one-day police custody, as per Hindustan Times in connection with the alleged assault of Sanjay Azad, father of 14-year-old student activist Nishu Azad, during a protest at Delhi’s Jantar Mantar. Bhardwaj was produced before the concerned judge at the judge’s residence in the Karkardooma Court complex after being arrested by Delhi Police in Uttar Pradesh’s Bulandshahr.
The arrest follows days of pressure from the Citizens for Justice and Peace (CJP), whose representatives had demanded stronger legal action against those accused in the June 23 incident. Bhardwaj has previously sought to justify his alleged actions, claiming that he acted in self-defence and saying that he would respond similarly if targeted again. Meanwhile, Delhi Police has rejected claims that Sanjay suffered a fractured skull, stating that his medical examination at RML Hospital found the injuries to be simple in nature. The police have also denied allegations of political interference in the investigation.
Arrest Follows Days Of Pressure
The case centres on an altercation during a CJP protest at Jantar Mantar on June 23, when Sanjay Kumar, a 38-year-old resident of Ghaziabad and father of student activist Nishu Azad, allegedly sustained a head injury during a scuffle. According to the FIR, Sanjay had been recording the demonstration on his mobile phone when an argument broke out over the filming. The situation subsequently turned physical, with Bhardwaj among those accused of assaulting him.
The matter gained renewed attention after videos circulated online in which Bhardwaj appeared to speak about the incident and claimed that he had attacked the protester’s father. He also suggested that political connections had helped him avoid jail. These claims prompted demands for his arrest and allegations of political interference. Delhi Police, however, has rejected those allegations as baseless, saying the investigation was conducted according to law. Deputy Commissioner of Police Sachin Sharma said the medical evidence did not support claims that Sanjay had suffered a skull fracture. According to the police, the injury was caused by a kada worn by one of the alleged accused and not by a weapon.
What Led To Bhardwaj’s Arrest?
The latest development follows an escalation in demands for action against Bhardwaj. CJP representatives, including spokesperson Saurav Das and co-convenor Ashutosh Ranka, had approached the Parliament Street Police Station and sought the addition of stronger provisions to the FIR. They also questioned why Bhardwaj had not been arrested earlier. The group alleged that the assault was more serious than reflected in the police case and also raised concerns about a caste-related dimension to the incident.
On September 4, Delhi Police detained Bhardwaj in Bulandshahr, Uttar Pradesh, after teams were reportedly deployed to trace him. Police sources said he had attempted to leave the area after learning that officers were looking for him. He was subsequently brought back to Delhi, arrested and produced before the court, which granted one day of police custody. The arrest came after police had earlier assured the CJP delegation that action would be taken within 72 hours.
Bhardwaj has maintained that he was acting in self-defence and has disputed the allegations against him. In comments reported after the controversy erupted, he claimed that he would have faced serious consequences had he not defended himself. The investigation will now have to establish what happened during the confrontation, who was responsible for the injuries and whether the allegations made by either side are supported by evidence.
The Logical Indian’s Perspective
The Jantar Mantar incident is a reminder that disagreements during public demonstrations must not descend into physical confrontation. Whatever the political, ideological or personal differences involved, violence cannot become a substitute for dialogue, and claims made on social media should not be treated as a substitute for evidence or due process.
At the same time, allegations against any individual must be examined fairly, with the rights of both the complainant and the accused protected through an impartial investigation. The Delhi Police’s medical findings and Bhardwaj’s own account should both be assessed alongside other evidence before conclusions are drawn. What matters now is that the investigation remains transparent, the law is applied equally to everyone, and those affected receive a fair hearing. Can accountability and peaceful dialogue coexist even when public disagreements become deeply polarised?
