Nitish Kumar Resigns From Bihar Legislative Council for Rajya Sabha After Two Decades in Politics

On Monday, March 30, 2026, Bihar Chief Minister Nitish Kumar formally resigned from his membership in the Bihar Legislative Council, marking the end of a two-decade-long era in state politics. The resignation, submitted by MLC Sanjay Gandhi to Council Chairman Awadhesh Narain Singh, follows Kumar’s election to the Rajya Sabha on March 16.

This move was a constitutional necessity under the Prohibition of Simultaneous Membership Rules, which mandate that a legislator vacate their state seat within 14 days of being elected to Parliament. While the JD(U) leadership deliberates on a successor, Kumar is expected to take his oath as a Rajya Sabha member on April 10, officially transitioning to the national stage.

A Rare Legislative Milestone

The transition is not just a change in office but the completion of a unique political journey. By entering the Rajya Sabha, Nitish Kumar will become one of the few Indian politicians to have served in all four legislative bodies: the Bihar Legislative Assembly, the Lok Sabha, the Bihar Legislative Council, and now the Upper House of Parliament.

State Minister Vijay Kumar Chaudhary confirmed that the resignation was purely a “procedural and constitutional requirement.” Meanwhile, Union Home Minister Amit Shah lauded Kumar’s tenure as “spotless and golden,” highlighting his role in Bihar’s development.

Despite the formal resignation from the Council, legal experts and JD(U) leaders, including Sanjay Jha, noted that Kumar could technically continue as Chief Minister for up to six months under Article 164(4) of the Constitution, though a new appointment is widely expected by mid-April.

Succession and State Dynamics

The move has sparked intense speculation regarding the next occupant of the Chief Minister’s residence at 1, Anne Marg.

Within the Janata Dal (United), names like Nishant Kumar Nitish Kumar’s son have surfaced in party posters, while BJP allies are reportedly considering leaders like current Deputy CM Samrat Choudhary or Nityanand Rai for the top post.

This shift comes on the heels of Kumar’s recently concluded ‘Samriddhi Yatra,’ which many viewed as a farewell tour of the state’s 32 districts. The transition marks a significant power shift within the NDA alliance in Bihar, with the BJP likely to take a more dominant role in the state’s executive leadership for the first time in twenty years
