Law Student Who Accused Chinmayanand Of Rape Denied Permission To Appear For Exams

The law student who had accused former Union Minister Swami Chinmayanand of rape was denied permission for writing her third-semester examination on Monday.

Mahatma Jyotiba Phule Rohilkhand University (MJPRU) in Bareilly, Uttar Pradesh, denied her permission of sitting in the examination claiming that she had less than the mandatory 75% attendance.

This came despite Chief Judicial Magistrate (CJM) Omvir Singh’s order on November 23, allowing the woman to sit for her second year LLM exams. The court had also instructed the jail superintendent to send the woman to the university in police custody.

“The woman didn’t even come for a day after admission and we cannot change laws for just one student. We have not received any direction either from the high court or Supreme Court to allow her to appear for her examination despite zero attendance,” Anil Shukla, MJPRU vice-chancellor, was quoted by The Times Of India.

He further told that there were directions for giving her admission which they did. Even the district court didn’t allow her any exemption in the attendance clause. In case any of the higher courts give him direction then he will conduct her examination considering it to be a special case.

However, the university had allowed the student to appear for her first term back paper on Monday, November 25.

“Today(Monday), the university allowed the woman to take her first semester’s back paper examination. But she will not be allowed to take her LLM’s third-semester examination which is starting from tomorrow (Tuesday),” Sunita Pandey, University’s Registrar was quoted by The Indian Express.

The student’s lawyer, Kalwinder Singh, has stated that he would file a contempt petition in the Supreme Court against the university’s action.

The 23-year-old was previously studying in Chinmayanand’s Swami Shukdevanand Law College. On September 2, the Supreme Court had arranged to enrol the woman and her brother to a different law college in Bareilly. Although she was given admission to the college in October, she could not attend any classes as she is in judicial custody.

At present, the law student and three others are lodged in a Shahjahanpur jail for allegedly blackmailing and demanding Rs 5 crore from Chinmayanand. The four were charged under IPC sections 385 (extortion), 506 (criminal intimidation0, 201 (disappearance of evidence) and 35(criminal act done with a criminal knowledge or intention) and section 67 of the Information Technology Act.

Meanwhile, Chinmayanand was arrested on September 20 based on the woman’s complaint and has been charged with sections 376 C (sexual intercourse by a person in authority), 354 D (stalking), 342 (wrongful confinement) and 506 (criminal intimidation) under IPC.
