A woman, who is a resident of south Delhi, had recently filed a complaint against her husband and in-laws for domestic violence. Her plea has been dismissed by the court. It has been found that she was misusing legal provisions to extort unjustified money from her husband.
For this act of hers, the court has imposed upon her a fine of Rs 1 lakh. As per reports, the woman had made-up various unjustifiable allegations and suppressed necessary facts to further harass her husband and in-laws.
Under the Protection of Woman from Domestic Violence (PWDV) Act, Metropolitan Magistrate Shivani Chauhan dismissed the complaint of the woman and said the aim is to provide relief to the victims of domestic violence and not the people who commit the crimes. In this case, the woman had used PWDV Act as a tool for her personal gain; hence, misusing the Act. The penalty imposed upon the woman of Rs. 1 lakh shall be deposited to the account of Blind Relief Association.
“It is a fit case which calls for imposition of exemplary cost on complainant, so that like-minded people are dissuaded from resorting to such mala fide practices and wrongdoers should not get benefit out of frivolous litigations, ,” the court said
The Logical Indian community welcomes this move of the court, because it gives faith to the general public that the law shall do justice, irrespective of the gender and also if a law is misused then it becomes hard for people to trust even a genuine victim.
