The Income Tax department on January 9 in its I-T reassessment order has stated that Congress President Rahul Gandhi and Congress leader Sonia Gandhi haven’t paid income tax returns which are around Rs 100 crores in 2011-12.

A report by Times Of India said that after reviewing both of their incomes in connection to the Associated Journals Ltd, the IT dept said that the Rahul and Sonia in the year 2011-12 had “escaped” incomes of Rs 155 Cr and Rs 155.4 Cr respectively, over what was declared.

Sources from the IT department said that where Rahul Gandhi declared returns worth Rs 68.12 lakh for that year, his colleague Oscar Fernandes’s income was found to be Rs 48.93 Cr.
P. Chidambaram who is appearing for Sonia Gandhi in an appeal made by Congress against the re-opening of the tax assessment in the Supreme Court said that the tax liability of Rs 44 crores had been wrongly imposed. He further pointed that the assessing officer of the department wrongfully concluded that Rs 141 crore of her income relating to Associated Journals Ltd. (AJL) escaped as she didn’t mention it while filing the return.

The I-T reassessment order said that Gandhi’s’ income of more than Rs 300 crore “escaped” and there tax liability is around Rs 100 crore.

On December 31, 2018, the assessment order was passed against Rahul Gandhi, Sonia Gandhi, and Fernandes after reassessing their income for 2011-12. Order copies were sent to them. Chidambaram is challenging the re-opening of the tax assessment, which was headed by Justice A K Sikri, said that IT officials decision lacked in common sense. The former Finance Minister pointed out that department concluded that she escaped income of Rs 141 crore after getting 1900 shares of Young Indian, which is Non-profitable Organisation.

As for now, the IT has filed its assessment order in the Court. The matter is scheduled to be taken up by the Court on January 29.
