Nirbhaya Gangrape Case: Convicts Will Be Hanged, Says The Top Court

“It is once again a victory for us, but we fight till these convicts get hanged. I am thankful to the supreme court to keep our faith restored on the judiciary.” said the mother of 23-year-old, who was gang-raped in 2012 in Delhi, while speaking to The Logical Indian.

On Monday, the Supreme Court upheld its judgment on the death sentence of three of the four convicts in the 2012 Delhi gangrape case. A bench, headed by Chief Justice Dipak Misra, delivered its verdict. The court rejected the review plea filed by Mukesh (29), Pawan Gupta (22) and Vinay Sharma (23) – the three convicted in the case.

The SC bench comprised of Chief Justice Dipak Misra, Justice R Bhanumathi and Justice Ashok Bhushan. Justice Ashok Bhushan while giving the judgment said, “All pleas of convicts were taken into account during the hearing of appeals against High Court order, and no new ground has been raised in review petitions to warrant reconsideration of death penalties awarded to the convicts.”

The fourth convict, Akshay Kumar Singh (31), did not file a review plea. Akshay’s advocate, A P Singh, said that “Akshay has not filed a review petition yet. We will be filing it,” as reported by the Indian Express.

There were six accused in the case. One of the accused, Ram Singh, allegedly committed suicide in the Tihar jail. The another accused, a juvenile was convicted by the juvenile justice board and was released after he spent three years in a rehabilitation centre.

In 2017, the top court had upheld the death sentence awarded to the four convicts by the Delhi High Court and the trial court.

After today’s verdict, convicts have two legal options left to prevent the death penalty – one is to file a curative petition and secondly to approach the President with the mercy petition.


The Incident

2012 rape Nirbhaya rape case created a huge uproar in the country leading to many changes in rape laws. It shook the conscience of the nation. The brutal rape and murder of 23-year old ‘Nirbhaya’ saw an outpour of anger.

The incident of gruesome gangrape happened when the girl was returning home along with her friend after watching a movie. Both the girl and her friend were beaten up and the six convicts brutally raped her. She had later died in a hospital in Singapore due to injuries inflicted on her by them.
