ICICI Bank To Refund Rs 2.7 Lakh After Fraudulent Withdrawal From Customer’s Account In 2006-07

The apex consumer commission has asked the ICICI Bank to refund over Rs 2.7 Lakh to a customer who lost the amount through an ATM fraud in 2006-2007, said a report by The Economic Times.

The National Consumer Disputes Redressal Commission (NCDRC) has also asked the bank to pay Rs 2000 compensation to Karam Singh from Haryana who lost Rs 2,07,368. Singh has alleged that during this three month period he did not receive any message from the bank indicating any transaction.

The NCDRC has upheld the decision of lower foras asking the bank to pay a compensation of Rs 2000 to Karam Singh. “The State Commission, as well as the District Forum, have based their conclusion on the issue of deactivation of the service of sending messages to the complainants for each transaction,” said NCDRC.

NCDRC presiding member BC Gupta further said, “It is clear from the record that the SMS alert service has been provided by the Bank to the complainant. It is not understood, however, why the aforementioned service was not operational during the period in question, that is from 21.11.2006 to 25.02.2007,” said a report by the Economic Times.


Allegations by the complainant

The last transaction made by Singh, the complainant was on 20 November 2006, and at that time, his account balance was Rs 2,07,627. He wanted to withdraw some amount from his account on 26 February 2007, his account balance showed up to be Rs 203 only.

He further alleged that the amount was fraudulently drawn from his account by somebody during the period 1 November 2006 to 25 February 2007. Yet, he did not receive any message on his registered mobile number. He also said that he did not receive the message regarding the maintenance of a minimum balance of Rs 5000.


Reaction of the bank

The bank, however, said that the debit card, as well as the PIN, was in the possession of the complainant and that no amount of money can be withdrawn without these details. The bank further added that there was no deficiency on their part and in some cases is a fraudulent withdrawal of any amount had taken place, it is the complainant who is to be held responsible for it.

The District forum, however, has rejected the bank’s contention and has asked it to refund the amount without any compensation.

It also urges its community members to ensure that they don’t fall prey to any such fraudulent activities. Fraudulent activities must be immediately reported and thereby brought to the notice of the concerned authority who would then initiate the steps to ensure that perpetrators of these activities are taken into the task.

The Logical Indian also upholds the decision of the lower foras in ensuring that Karam Singh does not fall prey to such fraudulent activities and gets his hard earned money returned along-with due compensation.
