Gujarat High Court Grants Six-Month Medical Bail to Asaram Bapu in 2013 Rape Case, Imposes Strict Restrictions

The Gujarat High Court on November 6, 2025, granted six-month interim bail to self-styled godman Asaram Bapu on medical grounds in a 2013 rape conviction case.

The bail is strictly limited to facilitating specialised medical treatment, with no suspension or alteration of his convictions or life sentences. This decision follows the Rajasthan High Court’s suspension of his sentence on similar grounds.

Asaram, 84, is serving life imprisonment for raping a minor at his Jodhpur ashram and remains under strict court and police supervision during this interim bail.​

Bail Granted Solely for Medical Reasons

The Gujarat High Court bench of Justices Ilesh J. Vora and R. T. Vachhani emphasised that the six-month interim bail for Asaram Bapu is granted exclusively on humanitarian grounds due to his deteriorating health.

His lawyer, senior advocate Devadutt Kamat, outlined that Asaram struggles with multiple severe ailments such as heart disease, hypertension, hypothyroidism, anaemia, and gastrointestinal illness, which require specialised care unavailable in jail facilities.

The court observed that earlier bail applications were rejected, but new medical reports influenced reconsideration. During bail, Asaram is barred from conducting religious gatherings, sermons, or meeting followers to prevent misuse of his temporary release.

He will remain under close police surveillance and must regularly report to designated authorities while adhering to prescribed treatment plans.​

The Gujarat government also suggested the possibility of transferring Asaram to a state prison equipped to provide required medical care if necessary.

The victim’s counsel, senior advocate B. B. Naik, contested the bail plea, arguing that the medical certificates did not establish that Asaram was in a critical condition warranting such relief, underscoring concerns about the potential precedent set by granting bail to convicted sexual offenders.​

Background: Serious Convictions and Previous Bail Pleas

Asaram Bapu’s legal journey in connection with sexual assault allegations spans over a decade. He was convicted and sentenced to life imprisonment in April 2018 by a Jodhpur court for raping a 16-year-old girl at his ashram in 2013.

A separate 2023 conviction in Gujarat for another 2013 rape case further solidified his status as a convicted criminal. He has also faced serious charges related to conspiracy and witness intimidation, with courts consistently upholding these convictions.

Despite numerous bail applications citing medical grounds, earlier pleas were mostly rejected by courts across Rajasthan and Gujarat for reasons including safety concerns and the seriousness of his crimes.

The Supreme Court granted Asaram interim bail for medical treatment in January 2024, initially until March, with subsequent extensions given by the Gujarat High Court based on his medical condition and hospitalisation needs.

These extensions came with strict instructions to prevent misuse of bail, including supervision and restrictions on contacting followers. ​

Asaram’s health significantly deteriorated over the past years, including hospitalisation in intensive care units and treatment for heart-related complications and other chronic illnesses.

In September 2025, he was even taken to Delhi for specialised treatment. The courts have balanced these medical realities with the imperatives of justice by imposing stringent conditions on his bail.​

Legal and Social Implications

Asaram Bapu’s case remains emblematic of the challenges in balancing prisoner rights with the demand for justice in high-profile sexual assault cases.

His multiple bail requests for medical reasons have triggered debate about whether compassionate grounds should override the severity of the crimes for which he was convicted.

The courts have emphasised that bail is a privilege and not a right, especially in cases involving heinous crimes. The continued surveillance and restrictions imposed on Asaram during bail reflect judicial vigilance to ensure that the bail does not translate into impunity or public harm.

Advocates for survivors of sexual violence express concerns about setting potentially lenient precedents for influential offenders seeking bail on health grounds.​

The victim’s legal representatives have consistently opposed bail extensions, highlighting that granting interim bail risks undermining public confidence in the justice system while potentially retraumatising survivors.

Meanwhile, authorities reaffirm their commitment to providing necessary medical care within jail or through supervised bail without compromising law and order.​
