A court in Shillong has granted bail to Sonam Raghuvanshi, the prime suspect in the high-profile “honeymoon murder” of her husband, Raja Raghuvanshi, after citing significant police procedural lapses. Despite being accused of plotting the May 2025 murder in Meghalaya’s East Khasi Hills, Sonam was released on a personal bond of ₹50,000 because authorities failed to properly inform her of the grounds for her arrest.
The court noted that police documents erroneously cited “dishonest misappropriation of property” instead of “murder,” a mistake the judge refused to dismiss as a mere “clerical error.” While the victim’s family has expressed shock and demanded a CBI probe, the ruling underscores the mandatory constitutional requirement to protect an accused person’s rights, regardless of the severity of the charges.
Systemic Failure Or Clerical Oversight?
The Additional DC (Judicial), Dashalene R. Kharbteng, observed that the “Intimation of Grounds of Arrest” provided to Sonam contained unticked checkboxes and referenced Section 403(1) of the Bharatiya Nyaya Sanhita (BNS) dealing with misappropriation rather than the graver Section 103(1) for murder.
Rejecting the prosecution’s claim that these were minor mistakes, the court stated, “Such error cannot occur in all documents,” and emphasized that these lapses caused “prejudice” to the defendant’s case. SP Vivek Syiem of the East Khasi Hills confirmed the development, stating, “The accused has been granted bail… however, the police will continue to pursue the matter as per law.”
Meanwhile, the victim’s mother, Uma Raghuvanshi, was seen visibly distraught, telling reporters, “I can’t understand how the game suddenly changed… I want a CBI probe into this case.”
The Honeymoon That Turned Into A Tragedy
The case dates back to May 2025, when Indore-based transport businessman Raja Raghuvanshi married Sonam. Just days into their honeymoon in Meghalaya, Raja went missing on May 23. His mutilated body was eventually recovered from a deep gorge near a waterfall in Sohra on June 2. Investigations led to the arrest of Sonam and several others, including her alleged paramour, with police filing an extensive 790-page chargesheet.
The victim’s brother, Vipin Raghuvanshi, has alleged that the investigation was “manipulated” and confirmed the family’s intention to challenge the bail order in the Meghalaya High Court. The court has currently restricted Sonam from leaving the Shillong district without prior permission as the trial continues.
The Logical Indian’s Perspective
At The Logical Indian, we believe that the strength of a democracy is measured by its adherence to the rule of law and the protection of constitutional rights. While the loss of a young life is an absolute tragedy that demands swift justice, this case serves as a stern reminder that procedural integrity is not a “formality” it is the bedrock of a fair trial.
When law enforcement agencies fail to follow mandatory protocols, such as correctly informing an individual of their arrest grounds, they inadvertently weaken the pursuit of justice for the victim. We advocate for a system where efficiency and empathy go hand-in-hand, ensuring that “clerical errors” do not stand in the way of truth. True harmony in society is achieved when the law is applied with precision and transparency for all parties involved.
