Wife Entitled to Higher Alimony if Living Costs Increase or Husband’s Income Rises, Rules Delhi HC

The Delhi High Court, led by Justice Swarana Kanta Sharma, recently ruled that a wife can seek an increase in alimony if her husband’s income rises substantially or if the cost of living escalates.

This ruling came in a case involving a 60-year-old woman whose plea for increased maintenance was initially denied by the family court, according to HT. The court emphasised that alimony must be calculated on the husband’s “free income,” excluding mandatory deductions but not personal debts designed to reduce maintenance liability.

Legal experts hail the judgment as a progressive measure balancing economic realities with fair financial support for dependent spouses.

Alimony Must Reflect Economic and Personal Realities

The case involved senior citizens married in 1990, living separately for nearly three decades. Initially, the wife received interim maintenance of Rs 3,000 per month, which was increased to Rs 10,000 in 2012. She later sought Rs 30,000 citing rising living costs and health problems.

The family court rejected this request, prompting her to appeal. Justice Sharma observed that the husband’s income had increased since the last maintenance order, along with a significant rise in the cost of living, constituting a clear change of circumstances warranting enhancement.

The court balanced the husband’s limited post-retirement income with the wife’s right to maintenance that allows her to live with dignity, ultimately raising her alimony to Rs 14,000 per month with arrears to be cleared promptly. Justice Sharma also directed the husband to restore the wife’s name on his government health card, ensuring her access to medical benefits.

The court also highlighted that legal obligations for maintenance cannot be evaded through artificial financial deductions. It observed that the dependent spouse’s health conditions and caregiving responsibilities merit special consideration, reinforcing courts’ duty to provide fair, dignified support.
