Three years ago, Sarvjeet Singh, a 28-year-old Delhi resident was termed an “eve-teaser” and a “pervert”. Accused in an alleged verbal harassment case, he is paying a heavy price for it. He doesn’t have a permanent job as he has to go to the court and police station time and again.
Whereas the complainant, Jasleen Kaur, hasn’t attended any hearing till now. It has been three years, and the arguments in his case are yet to begin. Sarvjeet while speaking toThe Logical Indianalleged that the delay is because the complainant Jasleen Kaur has not attended even a single hearing in the matter out of the 13 hearings so far and a Delhi district has issued a bailable warrant against her on August 28.
He further alleged that every time he goes to the court, his name is called, he writes his name on a paper and then the matter gets dismissed because of the absence of Jasleen. He said that he is stuck in a rut because of the charges.
Responding to the allegations, Jasleen Kaur, who is currently residing in Canada has refuted Sarvjeet’s claim. Regarding the non-bailable warrant issued against her, as alleged by Sarvjeet, Jasleen has said toThe Quint, “No bailable warrant has been issued against me.”
The Quintcould not independently verify this claim as Sarvjeet later said that the court proceedings of that day were not uploaded on the court’s website.
“The judge has already issued a bailable warrant against Jasleen and said a non-bailable warrant would be issued if she fails to show up at the next hearing. The judge also said the case would be dismissed if she doesn’t appear before the court at the date of the next hearing on 1 December 2018,” Sarvjeet reiterated.
ToThe Print,Jasleen Kaur in her reply to Sarvjeet’s claim that stated that Jasleen was summoned to the court 13 times, she said “Since it is a state case, I am just one of the witnesses and have not been summoned for the 13 hearings, as claimed by Sarvjeet and his lawyer. They are lying.”
There is a copy of the order dated May 16 which clearly shows that she was summoned by the court. ToThe Quint, she said “I was out of the country pursuing higher education, so my father represented me and informed the court that I will be attending the next hearing. I started this fight for a reason and I am not going to run away from it.”
Jasleen’s lawyer Ravinder Ruhil accepted that there were summons, but said that she cannot be forced to appear before the court as she is in Canada. “The court cannot pressure her to come. It is true that there have been summons but her father has been appearing in court and has told the magistrate that she is in Canada,” he said.
Jasleen’s uncle Prabhjit Singh said that as she is a witness in the case and she will appear before the court to record her statement. He said that Jasleen got an opportunity to study in JNU, but because of online abuse over the issue, she had to move to Canada with her mother and pursue higher education.
“Earlier, she was a student and did not get leave. The same was conveyed to the court by her father,” he said. “She is now working with a company in Canada and will have time to visit India and give her statement.”
If she fails to appear before the court on December 1, the case would be dismissed.
